Spanish tax residence certificate: when it is requested and what decides whether you get it
Esta guía en español → · Эта статья на русском →
If you receive income from another country, the payer or the other country’s tax authority may ask you to prove that you are tax resident in Spain so the double tax treaty can apply. Grupo Avanza Consultores, tax and accounting adviser in Paterna (Valencia), checks whether the Spanish Tax Agency has a record of your residence, requests the certificate on your behalf and, if it is refused, prepares the documents to reopen the request. We work remotely and reply in writing in English, with a quote before we start.
What it is and what it is for
A tax certificate is the document issued by the Spanish Tax Agency to prove facts about a person’s tax situation (article 70.1 of the General Regulations on tax management and inspection, Royal Decree 1065/2007). The tax residence certificate proves that you are resident in Spain, and it is the document used to prove residence to another country, for example so that a double tax treaty is applied.
The Spanish Tax Agency issues it on its website with a Secure Verification Code, so the foreign authority can check it, and in the format approved by Order EHA/3316/2010, according to its own website.
The other country’s forms
Some countries have their own form with a section to be certified by the Spanish authority, such as Portugal’s 21RFI or France’s 5000-ES. The Spanish Tax Agency states that you request the residence certificate on its website and note in that section of the form that the certification is attached as a separate document, with the same legal validity.
If the other country requires wording that the standard certificate does not include, it is requested as a generic certificate, naming the form and the country, or attaching the form through «Presentar documento y/o alegaciones», according to the Agency’s website.
What decides whether you get it
If the requirements are not met when you apply, the website generates a refusal document; you can then submit documents through «Presentar documentos y/o alegaciones» so the file is reopened (Spanish Tax Agency website). What is proved is tax residence, which depends on the criteria of article 9 of the Personal Income Tax Act (days spent in Spain, centre of economic interests).
When possible, the certificate is issued immediately. Otherwise, the general deadline to issue a tax certificate is 20 days, unless its own rules set another one, and failure to issue it in time does not mean it is deemed granted (article 73.1 of the Regulations).
What we do
We check your tax residence for the year requested and what the Spanish Tax Agency has on record about it. We request the certificate on your behalf, prepare the other country’s form with the note the Agency indicates and, if it is refused, the documents to reopen it. If you are under the special regime for people moving to Spain, the certificate is the one provided for in article 120 of the Personal Income Tax Regulations, explained in our Beckham Law guide.

Frequently asked questions
About the tax residence certificate
Will the Spanish Tax Agency fill in my country’s form?
It asks you to request the residence certificate on its website and to note in the foreign form’s section that the certification is attached separately; it has the same legal validity (Spanish Tax Agency website, «Tramitación de formularios de residencia fiscal»).
Why was my certificate refused?
Because the requirements to issue it were not met when you applied; the website then generates a refusal document. You can submit documents through «Presentar documentos y/o alegaciones» to reopen the file (Spanish Tax Agency website).
How long does it take?
When possible, it is issued immediately. Otherwise, the general deadline for a tax certificate is 20 days, unless its own rules set another one (article 73.1 of Royal Decree 1065/2007).
Can you request it for me?
Yes, if you authorise us to represent you before the Spanish Tax Agency; the request provides for acting on behalf of third parties (Spanish Tax Agency website). We first check what is on record about your residence.
