Renewing a temporary residence and work permit for employment in Spain

Español · Русский

If your temporary residence and work authorisation for employment (cuenta ajena) is about to expire, apply for renewal during the two months before its expiry date. Filing within that period extends the previous authorisation until the procedure is decided. Start by checking your decision letter and employment situation: renewing the authorisation and obtaining a new TIE card are separate procedures.

Grupo Avanza Consultores, based in Paterna (Valencia), reviews your authorisation, dates and documents. We can start remotely and reply in writing in English. Before accepting the work, we confirm its scope, the permitted form of representation and any steps you must attend in person.

Which renewal does this guide cover?

This guide covers temporary residence and work authorisations for employment under Spain’s general immigration regime, governed by articles 80 and 81 of Royal Decree 1155/2024. It does not automatically apply to students, arraigo routes, family members of EU or Spanish nationals, non-lucrative residence or permits under Law 14/2013. If your decision refers to another regime, we first identify the relevant procedure.

Deadlines and separate steps

Before expiry

Apply during the two months before the expiry date. Filing within that period extends the previous authorisation until the procedure is decided.

Royal Decree 1155/2024, article 80.1.

If it has already expired

Article 80.1 also provides for filing during the three months after expiry, extending the previous authorisation until a decision is made. Late filing may lead to penalty proceedings. Do not plan to wait until this period.

Royal Decree 1155/2024, article 80.1.

After approval

Once you are notified of a favourable decision, you must apply for the TIE in person within one month. Renewing the authorisation and having the card issued are separate steps.

Royal Decree 1155/2024, articles 81.2 and 209.

What if I have changed employer or lost my job?

Continuing in the same employment relationship is one renewal route, but it is not the only one. Article 80 provides for other situations involving work completed, a new contract or certain benefits, among others. Unemployment or a change of employer does not determine the outcome without checking the applicable route and evidence. Keep any contracts, Social Security employment history, documents showing why the job ended, jobseeker registration and benefit decisions you hold; the documents needed depend on your case.

What we review to prepare your application

Authorisation and dates

Your approval decision, TIE, passport and expiry date. If there is an earlier application, request for further documents or official notice, we review its content and the date it was received.

Employment situation and renewal route

Whether employment continues, changes of employer, work periods and relevant evidence of contracts, termination, jobseeker registration or benefits. Different cases need different evidence.

Documents and filing

We identify the applicable form, fees and supporting evidence. Before agreeing to file on your behalf, we check the permitted form of representation. Any criminal record requires the assessment provided for in article 80.5.

Is the renewed authorisation always valid for four years?

Article 81.1 provides for a four-year renewal unless long-term residence is appropriate. There is an exception: if the initial authorisation was valid for less than one year and a condition under article 80 is met, renewal is granted for the duration of the activity, up to a maximum of one year. We check the initial decision before stating the applicable duration.

What to include in your first message

Tell us which authorisation you hold, its expiry date, your province and whether you are still employed, have changed employer or have stopped working. If you have received a request for documents or a refusal, include the notification date. We can then identify what needs reviewing and whether we can take on the work.

Questions about employed permit renewals

Is renewing my NIE the same as renewing residence?

No. The NIE is an identification number. This procedure renews a residence and work authorisation for employment; a new TIE is requested after a favourable decision. We first check which document you hold and what is about to expire.

Can I apply after my permit has expired?

Article 80.1 of Royal Decree 1155/2024 provides for filing during the three months after expiry and extends the previous authorisation until the procedure is decided. Late filing may lead to penalty proceedings. The ordinary filing period is the two months before expiry.

Can I renew if I have changed jobs or am unemployed?

A renewal route may apply, depending on your work history, contracts, reasons the job ended, jobseeker registration and benefits, among other facts. Article 80 and your evidence must be checked. Those facts alone are not enough to promise an outcome.

When do I apply for the TIE after renewal?

Article 81.2 of Royal Decree 1155/2024 requires you to apply for the TIE in person within one month of notification of the favourable decision. The card and the authorisation are separate procedures.

Can you review my documents remotely?

Yes. The document review can start remotely. Before accepting the work, we confirm its scope and the permitted form of representation. You must apply for the TIE in person. We offer Spanish and Russian support and reply in writing in English.
